Terms and Conditions

CONSUMER TERMS OF SALE

PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE.

1. Formation of the contract
1.1 These terms of sale apply to all goods supplied by The Lite Spot (UK) Limited registered in England and Wales no. 5038933 ("Lite Spot").
1.2 No contract exists between you and Lite Spot for the sale of any goods until Lite Spot has received and accepted your order and sends you confirmation in writing or by email to the address or email address you have given. Once Lite Spot does so, there is a binding legal contract between us.
1.3 The contract is subject to your right of cancellation (see clause 6 below).
1.4 Lite Spot may change these terms of sale without notice to you in relation to future sales.

2. Description and price of the goods
2.1 The description and price of the goods you order will be as shown in Lite Spot's current catalogue or on its website at the time you place your order. Dimensions given may not include ceiling cups and fixings. You should contact Lite Spot prior to ordering if you require further information.
2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, Lite Spot will inform you as soon as possible, and give you the option of waiting for goods to arrive in stock, selecting an alternative or cancelling your order.
2.3 Every effort is made to ensure that prices shown in Lite Spot's current catalogue or shown on its website are accurate at the time you place your order. If an error is found, Lite Spot will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, Lite Spot will refund or recredit you for any sum that has been paid by you or debited from your credit card for the goods.
2.4 A delivery charge of £7.99 including VAT will be added to orders delivered to the UK mainland. There may be an additional surcharge for deliveries outside this area
2.5 The price of the goods are inclusive of VAT.

3. Payment
Payment for the goods can be made by any method shown on Lite Spot's website at the time you place your order. All goods must be paid for in full prior to leaving our premises. 

4. Delivery
4.2 If there is no one at the address given who is able to accept delivery of the goods, the carrier will place a card through your letterbox to inform you that they were unable to deliver your order. The carrier will endeavour to deliver your order on the next working day.
4.3 Every effort will be made to deliver the goods as soon as possible after your order has been accepted, and in any event within 30 days of your order unless ordered item is out of stock. However, Lite Spot will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery. In this case, Lite Spot will inform you as soon as possible. Lite Spot may deliver the goods by separate instalments.
4.4 You will become the owner of the goods you ordered and responsible for risk of loss of or damage to them once they have been delivered to you.
4.5 If the goods arrive by carrier and are obviously damaged you should sign the delivery note as damaged.

5. Liability
5.1 Any glass breakages and shortages must be notified in writing to Lite Spot as soon as possible and in any event no later than five days from the delivery date, otherwise Lite Spot will not accept any liability. Written notification of any other damaged or defective goods or any incorrect quantities must be given to Lite Spot within 10 days of the delivery date.
5.2 Once goods have been installed they cannot be returned unless faulty.  If found to be faulty Lite Spot will not accept any liability of any electrician bills incurred.
5.3 If you do not receive goods ordered by you within 30 days of the date on which you ordered them, Lite Spot shall have no liability to you unless you notify them in writing of the problem within 40 days of the date on which you offered the goods.
5.4 If you notify a problem to Lite Spot under this clause, their only obligation will be, at your option:
5.4.1 to make good any shortage or non-delivery;
5.4.2 to replace or repair any goods that are damaged or defective; or
5.4.3 to refund to you the amount paid by you for the goods in question.
5.5 Save as precluded by law, Lite Spot will not be liable to you for any indirect or consequential loss, damgage or expenses howesoever arising out of any problem you notify to us under this condition, and Lite Spot shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 5.4.3 above.

6. Your right of cancellation
6.1 You have the right to cancel the contract with Lite Spot at any time up to the end of 14 working days after you receive the goods (see below). A working day is any day other than weekends and bank or other public holidays.
6.2 To exercise your right of cancellation, you must give written notice to Lite Spot by hand or post, fax or email, at the address, fax number or email address shown below, giving details of the goods ordered and (where appropriate) their delivery.
6.3 If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to Lite Spot at your own cost and risk. The goods must be returned to the address shown below. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. The goods must be returned to Lite Spot in resaleable condition.
6.4 If you cancel your contract but Lite Spot has already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at your own cost and risk as soon as possible.
6.5 Once you have notified Lite Spot that you are cancelling the contract, Lite Spot will refund or recredit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods.
6.6 If you do not return the goods as required, Lite Spot may charge you a sum not exceeding the direct costs of recovering the goods.

7. Warranty
7.1 All goods supplied by Lite Spot are warranted free from defects for 12 months from the date of supply. This warranty does not affect your statutory rights as a consumer.
7.2 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by Lite Spot, failure to follow Lite Spot's instructions, or any alteration or repair carried out without Lite Spot's approval.
7.3 If the goods supplied to you develop a defect while under warranty, or you have any other complaint about the goods, you should notify Lite Spot in writing at the address, fax number or email address shown below as soon as possible.

8. Data protection
8.1 Lite Spot will take all reasonable precautions to keep the details of your order and payment secure, but unless Lite Spot is negligent, Lite Spot will not be liable for unauthorised access to information supplied by you.
8.2 Lite Spot will only use the information you provide about yourself for the purpose of fulfilling your order, unless you agree otherwise. Lite Spot would like to notify you of products and offers that may be of interest to you from time to time, and if you would like to be notified of these, please tick the box below. You can correct any information about you, or ask for information about you to be deleted, by giving written notice to Lite Spot at the address, fax number or email address shown below.

9. Applicable law
These terms of sale and the supply of the goods will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.

10. Events beyond our control
Lite Spot shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond their reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
